ALL deposits are non-refundable and nontransferable for the puppy described above unless the puppy is found to have a medical issue that will keep the Cockapoo Puppy from being a quality lifelong companion. If, at the 7 week health check, the Cockapoo Puppy is determined to be unfit for purchase, the Buyer is entitled to 1) an available cockapoo puppy 2) refund of deposit or 3) on the paid wait list in the #1 position for the Mom/Litter of their choice.
First deposits can be made with a personal check, Cashier's Check or PayPal. PayPal invoices can be sent for deposits, final payments, shipping charges, etc. however a 3.8% surcharge will be added to cover any fees charged by PayPal.
Seller has the right to terminate a sale and refund a deposit at any time for any reason.
Occasionally some Cockapoo puppies are discounted/price reduced due to age, color combination, etc. If this occurs this does not mean a discount or a reduced price on the Cockapoo Puppy you have a deposit on. There are no discounts/reductions on puppies already purchased.
BUYER will present the original email of the contract to SELLER in order to obtain refunds/replacement puppy on any portion of this Health Warranty.
If at any time within 72 TOTAL hours from date/time of pick up/delivery (including weekends and holidays) following the sale and delivery of a companion dog to the purchaser, a licensed veterinarian certifies the Cockapoo Puppy to be unfit for purchase due to a non-congenital cause or condition clearly attributed to the Seller, BUYER has the right to elect one of the following remedies:
1. Return the Cockapoo Puppy within 72 TOTAL hours and receive a refund of the purchase price; or
2. Retain the Cockapoo Puppy and to receive reimbursement for veterinary fees incurred before the BUYER's receipt of the veterinary certification and the future cost of veterinary fees to be incurred in curing or attempting to cure the Cockapoo Puppy, such reimbursement not to exceed 25% of the purchase price including sales tax; or
3. Return the Cockapoo Puppy to SELLER within 72 TOTAL hours and receive in exchange a Cockapoo Puppy of BUYER's choice, of equivalent value when a puppy becomes available;
4. If the Cockapoo Puppy dies within 72 TOTAL hours from date/time of pick up/delivery (including weekends and holidays) of delivery to BUYER, BUYER may receive a full refund of the purchase price, including sales tax, for the Cockapoo Puppy. Alternatively, BUYER may obtain a new Cockapoo Puppy of BUYER's choice of equivalent value. In either instance, BUYER will be reimbursed for veterinary fees incurred before the death of the Cockapoo Puppy if the death occurs within 72 TOTAL hours from date/time of pick up /delivery to BUYER, except where death occurs by accident or injury sustained during that period. The seller's liability for veterinary fees under this option must not exceed 25% of the purchase price, including sales tax, of the Cockapoo Puppy. Should the puppy die a necropsy must be performed by a licensed pathologist (not a veterinarian) to determine the cause of death. Failure to have a necropsy performed will render the Health Warranty null and void.
Should a replacement puppy be selected by the Buyer, the Buyer refuses the Cockapoo puppy when offered by the Seller, the Seller is released from all obligations to the Buyer.
SELLER shall accept the veterinary certification of unfitness delivered by BUYER within 48 hours following the initial veterinarian exam (as described above) of the Cockapoo Puppy. Failure to notify Seller or provide Seller with documentation/return puppy in timeframes outlined renders the Health Warranty null/void. The Seller retains the right to have the Puppy's condition validated by another licensed veterinarian of their choice. This warranty is void in the event of an undetermined or inconclusive diagnosis. The certification must contain:
1. Name of the owner with the date/dates of examination;
2. the breed, color, sex and age of the Cockapoo Puppy
3. a statement of the findings and that the veterinarian certifies the Cockapoo Puppy to be unfit for purchase;
4. an itemized statement of veterinary fees incurred as of the date of the certification;
5. all x-rays, documentation and veterinarian findings relating to the health defect
6. where the Cockapoo Puppy is curable, the estimated fee to cure the Cockapoo Puppy;
7. where the Cockapoo Puppy has died, a statement setting forth cause of death along with the necropsy report;
8. the name and address of the certifying veterinarian and the date of the certification.
SELLER guarantees for a period of six (6) months from the puppy's date of birth that the puppy shall be free from *permanently debilitating or life-threatening hereditary and genetic disorders. (*Permanently debilitating is defined here as blindness, cancer, inability to walk, heart or lung defect.) This guarantee does not cover non-life threatening or temporary disorders including, but not limited to umbilical or inguinal hernia, cherry eye, undescended testicles, uneven bite, grade 1 or 2 luxating patellas, grade 1 or 2 heart murmurs. If within this period BUYER seeks a refund due to a hereditary or genetic condition affecting the Cockapoo Puppy, SELLER must be notified immediately of the Cockapoo Puppy's condition by being provided with a printed and signed copy of the Cockapoo Puppy's complete medical history, test results, diagnosis and prognosis from the licensed veterinarian(s) who examined the Cockapoo Puppy and diagnosed its condition. SELLER retains the right to have the Puppy's condition validated by a veterinarian of SELLER's choosing. Such validation will occur within 60 (sixty) days of delivery of the Cockapoo Puppy's complete medical history to SELLER. Upon validation of the Cockapoo Puppy's condition, SELLER shall refund the original purchase price of the Puppy to the Buyer within 60 (sixty) days. In the unlikely event of the death of the puppy, laboratory confirmation via necropsy with a licensed pathologist (not a veterinarian) of cause of death with a licensed pathologist will be required. Refund in this instance will only be given if the death is attributed to a congenital/hereditary condition. Seller's liability is limited to the purchase price of said puppy. SELLER shall refund the original purchase price of the Puppy to the Buyer within 60 (sixty) days of receipt of all medical records/necropsy reports if the reports indicate puppy died from a hereditary/congenital condition. This warranty is void in the event of an undetermined or inconclusive diagnosis. Seller shall not assume liability for any veterinarian expenses only refund the purchase price of the puppy.
No refunds will be given at any time for travel to/from veterinarians, shipping puppy/dog, x-rays, laboratory fees, any treatments, medications or any veterinarian fees/care unless outlined above.
PLEASE NOTE: at no time, in any part of this Warranty, do we Warranty against conditions brought on by environmental changes, stress or exposure to adverse conditions that we cannot control once the puppy leaves our care. If the puppy shows no signs or symptoms of a problem we do not and cannot treat them. Therefore, we do not guarantee against Hypoglycemia, Coccidiosis, Giardia, Parasites (Internal or External), Viral, Bacterial or Fungal Infections or Ear Mites.
BUYER AGREES to take their puppy to a licensed veterinarian within 72 TOTAL hours from date/time of pick up/delivery (including week ends and holidays) from the Seller. This veterinarian appointment must include an overall health exam and fecal exam. If your regular veterinarian is not available, you are required to take the puppy to another veterinarian. Failure to have this exam on file will cause this guarantee to be null and void.
BUYER AGREES they will maintain the puppy in good condition according to veterinarian recommendations, including but not limited to adherence to a regular immunization schedule, heartworm preventative, spay/neuter, proper nutrition/weight for age and structure, annual worming, and flea prevention. Dog should be tested for internal parasites every three months until one year of age and twice yearly thereafter.
BUYER AGREES to keep the puppy/dog as an indoor family member, never leaving the puppy/dog outside unsupervised in a yard unfenced or tied outside. The Cockapoo Puppy is not to be kept in a small crate or cage except for crate training or house training.
BUYER AGREES to neuter/spay the puppy on or before Cockapoo puppy's 7 month birthdate. This puppy is sold as a companion dog not for breeding purposes.
BUYER AGREES the following defects are not considered serious/life threatening and are not covered under the guarantee: underbite/overbite, undescended testicles, umbilical hernias, regrowth of dew claws, cherry eyes, grade 1 or 2 luxating patellas, grade 1 innocent/juvenile heart murmur, Kidney/Bladder/Urinary Tract Infection, Allergies, Ear Mites, other common puppy problems such as fleas, lice or ticks, coccidia, giardia, parasites, kennel cough or any other type of bacterial /viral infections.
A diagnosis of coccidia, giardia, parasites, kennel cough or any other type of bacterial /viral infection does not render your puppy unhealthy. Each puppy has its own fecal exam by my veterinarian at the wellness check up. If a parasite is found, the puppy is treated and it will be documented on the puppy's health record. We cannot and do not treat for anything we do not see.
BUYER AGREES that if at any time the Buyer can no longer retain possession of this dog, the Seller is to be notified and given first option of resuming full ownership of dog in order for the Seller to locate this dog a new home. No refunds will be given unless agreed upon at the time of surrender to the Seller. The Breeder reserves the right to approve/prohibit any transfer of this animal to a third party. Under no circumstances will this dog be sold, leased, traded or given away to any pet shop, research laboratory, animal shelter or similar facility. The Buyer will never post this dog "for sale" on any internet forum including but not limited to Kijiji, Ebay, Puppyfind, Craigslist, NextDayPets, etc. or any newspaper, etc.
BUYER AGREES to maintain the puppy in good condition according to veterinarian recommendations, including but not limited to adherence to a regular immunization schedule, heartworm preventative, spay/neuter, proper nutrition/weight for age and structure, annual worming, and flea prevention.
BUYER AGREES to have the Cockapoo Puppy groomed at regular intervals so as not allow the coat of the Puppy/Dog to become matted and dirty. This means the Cockapoo should be groomed by a Professional Groomer about every 8 to 10 weeks.
BUYER AGREES the coat type of the Cockapoo will vary as characteristics are inherited from both the poodle and the cocker spaniel. There may even be some variety within a litter. The three possible coat types are a tight curly coat, a loose wavy/ringlet coat and a straighter coat. Acura Cockapoos, Inc. does not guarantee the coat texture of a puppy as it matures to an adult. We do not give any guarantee for adult size/structure, color changes, coat texture, eye coloring, shedding or hypo allergenic.
BUYER AGREES Parvovirus is not covered by this Warranty as the puppy has only been started on it's inoculations prior to going to their new home and family. Your puppy's immune system is not fully developed until he/she has completed it's series of puppy shots. Therefore we strongly urge you to take the following precautions:
Visits to the vet: Never put your puppy on the floor or the ground outside of the clinic, instead carry your puppy or use a pet carrier. Ask the vet staff to disinfect the exam table before you set your pup down for his/her exam. I know this may sound overly cautious but there are a lot of animals visiting the vet.
Dog parks, pet shops, puppy preschool, rest areas along freeways/roads and areas where other dogs of unknown health may have visited, should be off limits until your pup has completed his/her series of puppy shots.
At no time do we reimburse for time off work, travel time or gas expenses.
Shipping/transportation fees are not included in warranty. Shipping/transportation charges are the responsibility of the Buyer in all instances.
We do not give any guarantee for adult size/structure, color changes, coat texture, eye coloring, shedding or hypo allergenic.
Shipping is available at buyers expense. Shipping cost is NOT included in the price of the puppy. Shipping is not available from 5/15 to 9/15. Shipping other times of the year is $435 which includes airfare on Delta Airlines, vet visit for the required FDA health certificate to fly, airline approved carrier, gas/time to/from airport and airport parking. Final balance of the Cockapoo puppy and airfare must be paid 10 (ten) days prior to departure. Failure to pay 10 (ten) days prior to departure renders the sale null and void and the deposit is forfeited.
It is understood and agreed to by the parties to this agreement that this agreement and the purchase and sale of the said dog shall fall under the jurisdiction of the laws of the City of Irmo, South Carolina and the State of South Carolina and that any matters with respect to this Agreement shall be dealt with as per the laws governing this location. It is further understood that any circumstances, situations, disputes arising which are not covered within this Agreement shall be remedied at the discretion of the breeder and the breeder's decision shall be final and binding. This agreement is non-transferable.
This Health Warranty is non-transferable. It is only in effect for the original BUYER whose name appears on the PayPal Deposit or Personal Check provided to make the original nonrefundable/transferable deposit.
BUYER AGREES they have read and understand the terms set forth. BUYER AGREES that when they made their initial nonrefundable/transferable deposit via PayPal or other methods (personal check, cash) they automatically agreed to the terms and conditions set forth above in the Health Warranty.
